What to Do if You’re Pulled Over: Know Your Rights
By Advocate Siddharth Narang:
When pulled over by the traffic police, it is important to remain calm and cooperate. You must carry all the necessary documents in your vehicle, including the Registration Certificate (RC), Pollution Under Control (PUC) Certificate, Driving License (DL), and Bike insurance policy document.
Here are some tips on what to do when pulled over by the traffic police:
- Pull over to a safe location. If possible, pull over to the side of the road in a well-lit area. Avoid pulling over in dark or isolated areas.
- Roll down your window and turn off the engine. Greet the officer politely and keep your hands visible at all times.
- Provide the officer with your documents. The officer will likely ask for your driver’s license, registration, and insurance. Be sure to provide these documents promptly.
- Answer the officer’s questions honestly. If you are asked why you were pulled over, be honest with the officer. Do not argue or try to talk your way out of a ticket.
- If you are issued a ticket, be respectful and accept it. You have the right to dispute the ticket in court, but it is important to be polite to the officer even if you disagree with the decision.
Here are some additional tips:
- Do not argue or get into a confrontation with the officer. This will only make the situation worse.
- If you feel that your rights are being violated, you can politely ask to speak to a supervisor.
- You have the right to record the interaction with the officer on your phone. However, be sure to ask the officer’s permission first.
Traffic Police Rights
Traffic police officers have the authority to enforce traffic laws and ensure the safety of road users. They have the following rights:
- Pull over vehicles: Traffic police can stop vehicles to check for violations or conduct investigations.
- Seize vehicles: If a driver violates traffic laws, the police can seize the vehicle.
- Confiscate licenses: Under suspicion of violations, traffic police can confiscate a driver’s license but must provide a receipt.
- Arrest drivers: If a driver is under the influence of alcohol or illegal substances, the police can arrest them.
Remember, you can always ask for the officer’s ID if you are unsure of their authenticity.
