There are number of reasons why men face discrimination injustice under laws related to rape and sexual assault some of the reasons are that man may not be given a fair  trial or the opportunity to present evidence in their favor this can only happen when the legal system is not well equipped to deal with these false cases and in India the words of the women are assumed as truth according to various studies done by Delhi commission of women Rajasthan ,state women commission its estimated that 50% -79% of rape acquisitions are false this means that a number of men are falsely accused of rape each year in some cases of rape and molestation laws are not equal for all men and women the laws are not applicable equally they are used as a tool by number of women’s to gain publicity or to be in limelight’s or to extra Ord money .
Lack of gender neutrality is also one of the major reasons law related to rape and sexual assault are discriminatory as they are not gender neutral various studies have shown that the male child are equally prone to sexual assault as compared to girl child many laws like POSCO and STALKING do not provides same kind of sensitivity as it is provided to female over male.

This issue is not limited to the India even the other countries like USA Russia France UK and other countries the legal system is not well furnished to tackle these issues and sometimes it becomes very hard to prove the innocence due to which suicide rate is increasing all over the world day by day there are various ways that can be taken up to ensure that laws related to rape and sexual assault are not misused number one by providing fair and impartial investigation by ensuring that man are not falsely accused of rape or sexual assault.

(1) Investigations should be conducted fairly and impartially this means that the evidence should be collected and evaluated objectively and the accused should be given the opportunity to present evidence in their defence arrest should not be first step in this grave offences chance should be given to the accused to prove himself innocent
(2 ) Gender neutrality this means that the laws related to rape and sexual assault should be equally applicable to men and woman and should not be discriminatory against the men
(3) punish fall accuses should be taken seriously and should be punished accordingly this will stop people from fall ceiling someone to of rape for sexual assault and will help to protect the right of the accuse and the society at large
