Domestic Violence Cases in India : Procedure and way

Domestic Violence’s defend in India under protection of women from domestic violence act 2005 according to section 3 of the act any omission or commission of the respondent shell constitute domestic violence in case when someone give harms or injuries or endangered the health safety life or well being weather mentally or physically to the aggrieved person or tends to do so and includes causing physical abuse verbal and emotional abuse and economic abuse , harms give injuries or endangered person with the view to course her or any other person related to her to meet any unlawful demand for any dowry or other property or valuable security according to the survey report of (NFHS) National Family Health Survey of India 2006 the lifetime prevalence of sexual violence among women aged 15 to 49 years includes instance of marital rape

DV includes physical abuse like hitting beating, slapping, punching, pulling hairs burning ,cutting, pinching etc. it may include violent behavior or any  physical torture or physical harm cause to the victim by any person mostly married couples are the ones where the Domestic Violence occurs it can be in the form of sexual abuse it occurs when the abuser coheres the victim into having sexual contact with his partner without their consent this often takes the form of marital rape.

In India the study includes in its definition of sexual violence all instance of a woman experiencing her husband physically forcing her to have sexual intercourse with him even when she did not want to do forcing her to perform any sexual acts she did not want to the study sample (8373) women nationwide and found out that 8.5% of women in the age group of 15 to 49 years had experienced sexual violence in their lifetime the figure includes all forms of force sexual activities by their husband on wives during their marriage life but not recognized as the marital rape by Indian law there are various types of Domestic Violence physical violence ,emotional abuse ,sexual assault, honor killing, dowry  related abuse.

Reason that Why DV rates higher in India It is because men are frequently seen as the head of the household and exercise more authorities and control over woman due to this imbalance of power men may feel as though they have a right to dominate and rule over women which  result in domestic violence the domestic violence and other types of violent relationships are based on power and contact and increase of domestic violence may occur during the significant shift in life such as pregnancy or a family member illness

Over (69000 DV cases filed by women in year 2022 according to the data of nation commission for women violence against the women continues to be a serious concern it was seen according to the survey 2022 the number of Domestic Violence cases has emerged after the long down with the restrictions on mobility consignment within the home presence of abusers at home 24 hours during the Covid 19 crisis .coming to most helpline by society organization’s and human rights etc. in 2022 the number of Domestic Violence cases all over the world has increased domestic violence is not new now it has  existed in the society over the years.
